Finishing a critical component of the administration’s Regulatory Sprint to Coordinated Care, on November 20th, the Department of Health & Human Services released final rules revising the Physician Self-Referral Law (Stark) and the federal Anti-kickback Statute (AKS). With the issuance of these Final Sprint Regulations, the Centers for Medicare and Medicaid Services (CMS) and the HHS Office of the Inspector General (OIG) have taken concrete steps to reduce the regulatory barriers inhibiting the “volume to value” transformation of the health care system. The Final Sprint Regulations are published in the December 2nd Federal Register and, for the most part, will take effect on January 19, 2021.

To provide an overview of the Sprint Regulations and consider their practical implications, Davis Wright Tremaine is sponsoring a series of three webinars. As described in more detail below each webinar will focus on a separate component of the Final Sprint Regulations.

Done Sprinting But Are We There Yet? The Value-Based Stark Exceptions and AKS Safe Harbors

CMS Sprints to Overhaul Stark

With the benefit of more than three decades of rulemaking and hundreds of submissions under the Self-Referral Disclosure Protocol, CMS seized the opportunity in the Final Sprint Regulations to adopt a number of significant positive changes to the Stark Law. These regulations re-define key terms, create new exceptions, streamline existing exceptions and breathe new life into exceptions previously left for dead. This webinar will review the significant changes in the Sprint Regulations, noting some of the remaining ambiguities and practical implications.
